Terms of Service

These Terms of Service ("Terms") govern your access to and use of the software ("Software") provided by Artemis Software ("Company," "we," "us," or "our"). By installing, accessing, or using our Software, you agree to comply with and be bound by these Terms. If you do not agree to these Terms, do not use the Software.

1. LICENSE AND USAGE

1.1 License Grant
Upon purchasing or acquiring a copy of the Software, we grant you a non-exclusive, non-transferable, revocable license to install and use the Software on your personal computer or device. This license is provided for personal or commercial use within the scope of the Software's intended functionality.

1.2 License Restrictions
You may not:

• Share, sell, rent, lease, sublicense, or otherwise distribute copies of the Software to third parties without the express written consent of the Company.

• Reverse engineer, decompile, disassemble, or attempt to derive the source code of the Software.

• Modify, tamper with, or create derivative works of the Software in any form.

• Use the Software for unlawful purposes or in a manner that would harm the integrity of the Software.

2. DISTRIBUTION AND THIRD-PARTY USE

2.1 Authorized Distribution
The Software is distributable by you in accordance with these Terms. However, any distribution must include all original documentation and license information, and you are prohibited from charging any fees, except those approved by the Company.

2.2 Restrictions on Use by Third Parties
You agree that you will not allow others to use the Software under your license. Your license is strictly personal, and any unauthorized use by third parties will be considered a breach of these Terms.

3. LIMITATION OF LIABILITY

3.1 No Liability for Damages
The Software is designed to optimize the performance of your PC. However, you acknowledge and agree that the Company cannot guarantee any specific outcomes, and that there is no possibility that the Software will permanently damage your PC. If any issues or errors arise as a result of using the Software, it is solely your responsibility. The Company is not liable for any loss, damage, or other consequences that occur from using the Software.

3.2 Exclusion of Warranties
The Software is provided "as is," without warranties or representations of any kind, either express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

4. REFUNDS AND RETURNS

4.1 Refund Policy
Refunds are not guaranteed and will be handled on a case-by-case basis. In the event you experience difficulties or dissatisfaction with the Software, please contact our customer support team, and we will assess the situation to determine whether a refund or other action is warranted.

5. SERVER HOSTING AND DATA PROCESSING

5.1 Hosting Locations
The Software's servers are primarily hosted in Hong Kong, Germany, Ireland, and Brazil. However, we reserve the right to change server locations at our discretion, and these locations are not limited to the aforementioned countries. By using the Software, you consent to the processing of your data in these jurisdictions, as well as any future server locations chosen by the Company.

5.2 Data Privacy
The Company takes your privacy seriously. For more information about how we collect, store, and process your personal data, please refer to our Privacy Policy, which is incorporated into these Terms.

6. INTELLECTUAL PROPERTY

6.1 Ownership of the Software
The Software, including all related intellectual property rights, remains the exclusive property of the Company. This includes, but is not limited to, the Software's code, designs, trademarks, and documentation. Your use of the Software does not grant you any rights to these intellectual properties beyond the limited license described in Section 1.

7. PROHIBITED ACTIVITIES

7.1 Tampering and Reverse Engineering
You agree not to reverse engineer, decompile, or modify the Software in any manner, nor tamper with or attempt to alter the Software's functionality in any way. Any such actions will result in the immediate termination of your license.

7.2 Sharing of Licenses
You are prohibited from sharing your Software license with any third party. This includes lending, transferring, or selling your license key, or otherwise allowing others to use your Software under your account.

8. LICENSE TERMINATION AND CANCELLATION

8.1 Termination of License
We reserve the right to cancel or terminate your license to use the Software at any time, at our sole discretion, for any reason we believe violates these Terms. This decision is final, and we are not required to prove any violations. Upon termination, you must immediately stop using and uninstall the Software. License termination voids all possibility of a refund upon user discretion. License cancelation allows for the opportunity for refund requests upon our or the users discretion.

9. NO LITIGATION

9.1 No Right to Litigate
By agreeing to these Terms, you waive any right to initiate or participate in any form of litigation, including class action lawsuits, against the Company in relation to the Software. This includes any claims regarding performance, bugs, or damages that may arise from the use of the Software.

10. CHANGES TO THE TERMS OF SERVICE

10.1 Modifications to These Terms
The Company reserves the right to modify or update these Terms at any time. You will be notified of any changes through the Software or by other means. Your continued use of the Software after the changes are made constitutes your acceptance of the modified Terms.

11. SEVERABILITY

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions will continue in full force and effect.

12. GENERAL TERMS

12.1 Entire Agreement
These Terms, together with any other legal notices and agreements published by the Company on the Software, shall constitute the entire agreement between you and the Company concerning the Software.

12.2 No Waiver
No failure or delay by the Company in exercising any right, power, or privilege under these Terms shall operate as a waiver thereof.
